Legal Agreement

These Terms and Conditions constitute a legally binding agreement between you and Eco Crystal Clean regarding your use of our website and cleaning services. By accessing our website or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these terms.

1. User Obligations and Responsibilities

You are responsible for complying with all applicable laws, regulations, and ordinances related to the property where services are performed. This includes ensuring that our team's access to and work within the property does not violate any local regulations or building policies.

2. Indemnification and Hold Harmless

You agree to defend, indemnify, and hold harmless Eco Crystal Clean, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to:

• Your violation of these Terms and Conditions
• Your violation of any law or the rights of any third party
• Your use of our services or website
• Any content you submit or make available through our services

This indemnification obligation will survive the termination of your relationship with Eco Crystal Clean and your use of our services.

3. Disclaimers and Limitation of Warranties

3.1 Service Disclaimer

Eco Crystal Clean makes no representations or warranties of any kind, express or implied, regarding the operation of our services or the information, content, or materials included therein. 3.2 No Guarantee of Results

While we strive to provide high-quality cleaning services, we do not guarantee specific results. The effectiveness of cleaning may vary based on factors including but not limited to the condition of surfaces, age of stains, material composition, and environmental factors beyond our control.

3.3 Website Accuracy

We do not warrant that the information on our website is accurate, complete, or current. The material on our website is provided for general information only and should not be relied upon as the sole basis for making decisions without consulting primary, more accurate, or complete sources of information.

4. Limitation of Liability

4.1 General Limitations

To the maximum extent permitted by applicable law, in no event shall Eco Crystal Clean or its affiliates, directors, officers, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use our services
• Any conduct or content of any third party on the services
• Any content obtained from the services
• Unauthorized access, use, or alteration of your transmissions or content

4.2 Damage to Property

While we maintain appropriate insurance and take precautions to prevent property damage, Eco Crystal Clean's liability for any damage to property is limited to the direct cost of repair or replacement, not to exceed the amount paid for the specific service that resulted in the damage. We are not liable for pre-existing damage or conditions that were not disclosed prior to service.

4.3 Maximum Liability

Notwithstanding anything to the contrary contained herein, Eco Crystal Clean's total liability to you for all damages, losses, and causes of action shall not exceed the amount you paid to Eco Crystal Clean for services during the three months preceding the event giving rise to the liability.

5. Force Majeure

Eco Crystal Clean shall not be liable for any failure or delay in performing our obligations under these Terms and Conditions where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

6. Governing Law and Jurisdiction

6.1 Applicable Law

These Terms and Conditions and any separate agreements whereby we provide services shall be governed by and construed in accordance with the laws of the State of New York, United States, without giving effect to any choice or conflict of law provision or rule.

6.2 Dispute Resolution

Any dispute arising from or relating to the subject matter of these Terms and Conditions shall be finally settled through good faith negotiation. If the parties are unable to resolve the dispute through negotiation, the dispute shall be submitted to binding arbitration in New York County, New York, in accordance with the rules of the American Arbitration Association then in effect.

6.3 Waiver of Class Actions

Any proceedings to resolve disputes will be conducted solely on an individual basis. You agree not to seek to have any dispute heard as a class action, representative action, collective action, or private attorney general action.

7. Severability and Waiver

7.1 Severability

If any provision of these Terms and Conditions is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions will continue in full force and effect.

7.2 Waiver

No waiver by Eco Crystal Clean of any term or condition set forth in these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure to assert a right or provision under these terms shall not constitute a waiver of such right or provision.

8. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and Cookie Policy, constitute the sole and entire agreement between you and Eco Crystal Clean regarding our services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such services.

9. Modifications to Terms

Eco Crystal Clean reserves the right, at our sole discretion, to modify or replace these Terms and Conditions at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using our services.
